Terms of Service

CONTINUUMAI TECHNOLOGIES LLC

These Terms of Service govern the access and use of the digital platform operated by ContinuumAI Technologies LLC, a company incorporated under the laws of the United States of America (hereinafter, "ContinuumAI"), which provides technological services in the United States, Mexico and other territories.

By accessing or using the platform, the User fully accepts these Terms.

1. DEFINITIONS

"Platform" means the set of systems, software, modules, applications, APIs and digital tools operated under the ContinuumAI brand, including:

  • ContinuumAI Infrastructure
  • ContinuumAI for Education
  • ContinuumAI Logistics
  • GeoculturAI
  • Cognitive Chat and Collaboration
  • Payment Integrator (when applicable)

"User" means any natural or legal person who accesses, uses or contracts the services.

"Institutional Client" means any educational, corporate, governmental or business entity that contracts the services.

2. NATURE OF THE SERVICE

ContinuumAI provides an enterprise artificial intelligence platform under a SaaS (Software as a Service) modality.

Services may include:

  • Automated information analysis
  • Content generation
  • Logistics optimization
  • Territorial analysis
  • Educational systems
  • Collaborative tools
  • Administrative management
  • Integration with external systems

ContinuumAI is not an educational, financial, legal or medical entity, and does not replace human professional decisions.

3. ACCEPTABLE USE

The User agrees not to use the Platform to:

  • Illegal activities
  • Generate illicit or harmful content
  • Violate third-party rights
  • Attempt to access unauthorized systems
  • Extract or replicate the model or technological architecture

In the case of educational institutions, the Client is responsible for establishing internal rules of use for students and teachers.

4. INTELLECTUAL PROPERTY

All software, cognitive architecture, source code, algorithms, design, brand and structural content of the platform are the exclusive property of ContinuumAI Technologies LLC.

The User obtains a limited, non-exclusive, non-transferable and revocable license to use the platform according to the contracted plan.

Reverse engineering, copying, modifying or redistributing the system is prohibited.

5. DATA AND PRIVACY

ContinuumAI operates under international data protection standards.

The data entered by the Client:

  • Remains under the ownership of the Client
  • Are not sold to third parties
  • Are not used to train models without explicit authorization

In the case of minors (Education):

  • The institution is responsible for the corresponding consent
  • The red flags module only generates alerts, not diagnoses
  • Disciplinary decisions are institutional responsibility

Data processing is additionally governed by the Privacy Policy published on the site.

6. PAYMENT MODULE (EDUCATION)

When the Payment Integrator is enabled:

  • ContinuumAI may integrate third-party payment gateways
  • It is not a banking institution
  • Does not retain funds unless specific agreement
  • Transactions are processed by certified providers

The institution is responsible for:

  • Setting amounts
  • Verifying charges
  • Fulfilling tax obligations

ContinuumAI is not responsible for external payment provider failures.

7. SERVICE AVAILABILITY

ContinuumAI strives to maintain continuous availability, but does not guarantee uninterrupted operation. There may be:

  • Scheduled maintenance
  • Technical updates
  • Interruptions due to external causes

8. LIMITATION OF LIABILITY

ContinuumAI shall not be liable for:

  • Decisions made based exclusively on results generated by the AI
  • Indirect or consequential losses
  • Incorrect interpretations of the generated content
  • Failures derived from third-party integrations

Total liability, in all cases, shall not exceed the amount paid by the Client in the last 12 months.

9. SECURITY

ContinuumAI implements:

  • Encryption
  • Access control
  • Multi-tenant isolation
  • Internal monitoring

However, no system is absolutely invulnerable. The User is responsible for protecting their credentials.

10. PLANS AND PAYMENTS

Services can be offered under:

  • Monthly subscription
  • Annual subscription
  • Institutional licensing
  • Pay-per-use model

Payments are non-refundable unless expressly stated in the contract.

ContinuumAI may suspend services in case of non-payment.

11. TERMINATION

ContinuumAI may suspend or terminate accounts in case of:

  • Misuse
  • Breach of contract
  • Security risk

The Client may cancel according to their contract.

12. MODIFICATIONS

ContinuumAI may modify these Terms at any time. The updated version will be published on the official site.

13. GOVERNING LAW

These Terms will be governed by the laws of the State where ContinuumAI Technologies LLC is registered, United States of America.

For operations in Mexico, complementary provisions in accordance with Mexican law may apply. Any dispute shall be submitted to competent jurisdiction in accordance with the signed contract.
